Confidentiality
Confidentiality of educational records is a basic right shared by all students in the district and their parents. These fundamental rights are described in the Family Educational Rights and Privacy Act (FERPA) of 1974, as amended (2011). (SCPG) An educational agency or institution must use reasonable methods to ensure that school officials obtain access to only those education records in which they have legitimate educational interests.
Consent from the parent or adult student is required before education records may be released (34 CFR § 300.622). Some situations which require parental consent include, but are not limited to, the following:
- Sharing information with officials of participating agencies providing or paying for transition services according to an IEP. This consent is documented on the Request to Release or Secure Confidential form.
- Sharing information with private schools if a child is enrolled in a private school receiving special education services from the LRE or the child is going to enroll in a private school. This consent is documented on the Request to Release or Secure Confidential Information form. This form is accessed through the “Add Action” menu in Enrich IEP.
- Accessing reimbursement from Medicaid for special education services. This consent is documented on the Consent for Medicaid Reimbursement form obtained by health services.
Consent from the parent is not needed to disclose information under the following conditions:
- Sharing information with other public school officials, including teachers, within the agency or institution whom the agency or institution has determined to have legitimate educational interests.
- Sharing information with contractors, consultants, volunteers, or other parties to whom an agency or institution has outsourced institutional services or functions. These parties may be considered school officials under this paragraph provided that the outside party:
- Performs an institutional service or function for which the agency or institution would otherwise use employees;
- Is under the direct control of the agency or institution with respect to the use and maintenance of education records; and
- Is subject to the requirements of § 99.33(a) governing the use and disclosure of personally identifiable information from education records.
- Sharing information with officials of another public school or school system, or institution of postsecondary education where the student seeks or intends to enroll, or where the student is already enrolled so long as the disclosure is for purposes related to the student’s enrollment or transfer.
Set Up and Filing of Subsequent Meetings
Case Managers are responsible for setting up and maintaining special education records. Included below is an explanation of this process for both initial placements, and new transfers into the school district. Materials for setting up Special Education Files have been sent to the Contact Teacher at each school location. This information and materials should be distributed to other Case Managers.
Setting up a New File (for students newly identified or new to the district):
- MANILA folder:
- Staple Individual File Access/Release Record inside the LEFT side of the manila folder. Place Court Orders (if applicable) behind File Access/Release Form)
- Staple completed Social and Developmental History inside the RIGHT side of the manila folder (if not available electronically).
- On the tab, legibly write LAST NAME, FIRST NAME, and MIDDLE NAME. Under the name write the student ID number followed by the date of birth.
- Place manila folder inside a RED folder. (For Parentally Placed Private School Students (PPPSS), the manila folder will be placed inside an ORANGE folder.)
- Organize and staple paperwork by event. (Refer to checklists for information related to required paperwork.)
- Event paperwork is placed in the manila folder, within the red file, in order from OLDEST on the bottom to MOST CURRENT on the top.
- Place a rubber band around each individual red “jacket” to keep all paperwork together.
- The new Special Education File will be filed alphabetically in the designated location in the school’s records room within two school days of the event.

NOTE: If a student is determined eligible for special education services, but the parent does not give consent for the initial provision of special education services the following items will be filed by the case manager in the student’s yellow A Team folder and placed in the back of the student’s permanent record:
- Original Consent to Evaluate
- Original signed evaluation
- Original Multi-disciplinary Team Report with signatures
- Consent for initial provision of services indicating that the parent did not give permission for the provision of services
- Prior Written Notice
Maintaining Files for Subsequent Meetings:
- Checklists for required paperwork by meeting type can be found in the EasyIEP system in the Main Menu documents in the IEP section.
- Meeting paperwork should be placed in the manila folder, within the red file, in order from OLDEST on the bottom to MOST CURRENT on top.
- Paperwork for each meeting should be placed in order, from start to finish (refer to meeting checklists), and STAPLED prior to being placed in the special education file.
- Paperwork must be filed within two school days of the meeting.
- All filed paperwork must be final and original documents.
- Place a rubber band around each individual red “jacket” to keep all papers together.
Transferring and Moving Files for Students with Disabilities
Students Transferring Out of District
Education records include personally identifiable information, and may not be released to another agency or organization without parent consent. However, when a student transfers to another public school, education records may be forwarded if the parent has received the FERPA Annual Notification of Rights. Schools are permitted to disclose a student's education records to officials of another school, school system, or institution of postsecondary education where the student seeks or intends to enroll. Schools may NOT withhold records because of fines or other such reasons.
Follow district procedures for transferring student records.
- Remove the student’s permanent record and special education file from the records room and document this removal in the school’s record log book.
- Send copies of the following documents to the student’s new school: current IEP, most recent evaluation(s), most recent eligibility form, most recent reevaluation paperwork if applicable, FBA and BIP, if applicable, according to district file transfer procedures.
- Complete the Withdrawal (Inactive File Transfer) form and place it inside the special education file.
- Place the student’s special education file progress monitoring folders/data together in a courier envelope and send to one of the following locations:
- School-age: Special Education Inactive File Room at M. T. Anderson Support Center
- PreK: Inactive files, M.T. Anderson Support Center (Attn: Stephanie Shaffer)
Students Transferring Within District:
Follow district procedures for transferring student records.
- Remove the student’s permanent record and special education file from the records room and document this removal in the school’s record log book.
- Place the student’s permanent record and special education file together in a courier envelope (if it will fit) and send to the student’s new school per requirements in IA Bulletin #0001.
- The receiving teacher can access a copy of the IEP through the EasyIEP program for information needed before the file arrives at the school.
Rollup Files and File Transfers Over the Summer:
Follow district procedures for transferring student records.
- At the end of the school year the Case Manager places the progress monitoring folders in front of the Special Education file and binds them together with a rubber-band
- Remove the student’s Special Education file from the records room and document this removal in the school’s record log book.
- Permanent Record and Special Education file should be transferred together.
Students Exiting from Special Education Services:
- Case Manager places the progress monitoring folders in front of the Special Education file and binds them together with a rubber-band.
- Complete the Withdrawal (Inactive File Transfer) form and place it inside the special education file.
- The red cover is removed from the Special Education file and the file is placed in the back of the permanent record.
- Document this removal in the school’s record log book.
Requests for Copies of Special Education Information
Access to Records
The FERPA and federal and state special education laws and regulations require schools to have reasonable policies in place to allow parents to review and inspect their child's records. An education record means those records that are directly related to a student and maintained by an educational agency or institution or by a party acting for the agency or institution.
Educational records may include, but not limited to:
- academic work completed and level of achievement
- attendance data
- scores and test protocols of standardized intelligence, aptitude, and psychological tests
- interest inventory results
- health data
- family background information
- information from teachers or counselors
- observations and verified reports of serious or recurrent behavior patterns
- IEPs
- documentation of notice and consent
IDEA regulations stipulate, “(a) Each participating agency must permit parents to inspect and review any education records relating to their children that are collected, maintained, or used by the agency under this part. The agency must comply with a request without unnecessary delay and before any meeting regarding an IEP, or any hearing pursuant to § 300.507 or §§ 300.530 through 300.532, or resolution sessions § 300.510, and in no case more than 45 days after the request has been made.” The FERPA regulations allow some exceptions to the requirement to obtain parent consent before releasing records. All of these exceptions also apply to the confidentiality requirements in the federal special education regulations (34 CFR § 300.622(a)). FERPA allows the school to release records to authorized individuals, including but not limited to the following:
- other school officials, including teachers at the school where the student attends, who have a legitimate educational interest (34 CFR § 99.31(a)(1));
- officials of another school, LEA, or postsecondary educational institution where the student is enrolled or seeks or intends to enroll, If (a) the LEA's annual notice included a notice that the LEA forwards education records to other agencies that request records and in which the student seeks or intends to enroll; or (b) the LEA makes a reasonable attempt to notify the parents or the student of the disclosure at the last known address (34 CFR § 99.31(a)(2)), however no notice is required if the disclosure is initiated by the parent or adult student;
- disclosure in connection with financial aid for which the student has applied or received to determine eligibility, amount, or conditions of the aid or to enforce the terms and conditions of the aid (34 CFR § 99.31(a)(4)).
Upon parent receipt of requested copies of special education documents, case managers will document their receipt of requested copies on the
Parent Access Documentation form. This form will be filed in the student’s special education file.
