IDEA requires public school districts to provide a Free and Appropriate Public Education (FAPE) to all students with disabilities through age 21. Adult education programs are available to young adults 17 years of age and older who have not graduated with a state high school diploma and who may lack sufficient mastery of basic education skills. A student cannot maintain enrollment in a regular school setting and enroll in an adult education program at the same time.
Greenville County Schools (GCS) is responsible for the provision of a FAPE to all students with disabilities, including those who are enrolled in our Adult Education programs. Students with disabilities cannot be compelled to enroll in an adult education program to receive services, nor can they be compelled to withdraw from an adult education program on the basis of a disability. The same statutes, regulations, policies, and procedures that govern services in a K-12 setting also apply to the adult education setting. This applies to policies/procedures regarding Least Restrictive Environment (LRE), continuum of services, placement decisions, IEP components, related services provision, discipline, transportation, procedural safeguards, and all other due process requirements. In addition, all Child Find and reevaluation requirements are the same for students enrolled in adult education programs.
Special education services must be provided to students with disabilities enrolled in GCS adult education program. The IEP team is responsible for determining the appropriate special education and related services that will be provided in the adult education setting. No decisions can be made unilaterally.
Lifelong Learning (LLL), through its GED Center and High School Units program, offers students the opportunity to return to school and finish their education. High school students must be withdrawn from their high school in order to enroll in the LLL program as students cannot be dually enrolled. IDEA regulations clarify that a GED does not meet the definition of a regular high school diploma and does not end the district’s responsibility to provide a student with a disability a Free and Appropriate Public Education (FAPE).
If a student turns age 21 after September 1 of the current school year, the LEA must permit the student to enroll and complete the school year if the student will graduate or exit with a State High School Diploma, a GED, or a District Credential (non-diploma). The district must make a FAPE available to any eligible student who has not graduated with a State High School Diploma until the end of the school year in which the student turns 21. When a student with eligibility for services under IDEA enrolls in LLL, a FAPE must be provided including those services comparable to the services in the student’s IEP. The Case Manager at the LLL Program shoulld contact Special Education Data Entry Personnel to determine if the student previously met eligibility under the IDEA. The transfer process procedures will be followed for students with disabilities who enroll in LLL after withdrawing from their high school.
