Between annual reviews, any member of the team may propose a change to the IEP team for consideration, and the team may determine that it is appropriate to amend portions of the IEP without rewriting the entire IEP. Amendments to the IEP may be made in one of two ways: an Amendment with a meeting or an Amendment without a meeting. If the IEP team decides that no amendments to the IEP are needed, they are required to provide a Prior Written Notice (PWN) to the parents. This notice documents the considerations, participants and the decision made by the IEP team.
Changes to the IEP which require IEP team input must be made through a Special Review IEP meeting. Examples of these changes include, but are not limited to, an increase or a decrease in Special Education or Related Services, changes in least restrictive environment (LRE) placement, adding or removing areas of need, adding or changing present levels of performance and goals/objectives (required if student has mastered goals in the IEP or if goals are no longer appropriate for the student), changing from a traditional high school schedule to a block schedule and vice versa. Upon completion of the Special Review IEP meeting, the Parent/Guardian/Age of Majority Student must be provided with a revised copy of the IEP with the amendments incorporated. Prior Written Notice is required for all Special Review IEP Amendment meetings.
In amending a student's IEP, the Parent/Guardian/Age of Majority Student and the LEA representative may agree not to convene an IEP team meeting for the purpose of making those changes, and instead may develop a written document to amend or modify the child’s current IEP. If changes are made to the student's IEP without a meeting, the LEA must ensure that the student's IEP team is informed of those changes (34 CFR § 300.324(a)(4)). These changes may include changes to testing accommodations which may be needed as a result of new assessment information. Guidelines for amending the IEP without convening a meeting are as follows:
